Bankruptcy Law Updates

This session will focus on the latest amendments to Bankruptcy forms for mortgage creditors and Rules and plan form proposals that are being considered for 2016 and later:

The first portion will include discussion of the latest changes to Federal Bankruptcy Forms, effective 12/1/15, pertaining to the requirements for Proofs of Claim. This will include an in-depth discussion of legal and operational issues faced by servicers and law firms with relation to preparing and filing the POC 410and 410A. We will also include a brief overview of other changes effective December 1, 2015, including 4100R, the Notice of Final Cure Payment Directors Form.  The second portion of the session will address what’s still to come in 2016. This will include a discussion of the Bankruptcy Rules Committee’s updates with regard to a proposed National Plan, Proof of Claim bar date; a discussion of the newest issues affecting Bankruptcy, including statute of limitations; chapter 20 cases and lien strips; and CFPB proposed rule-making on monthly statements, early intervention notices, and cease and desist notices in bankruptcy.
